Terms
What Loudwell is
Loudwell is a Mac app that plans and makes social media posts for your brand, with a free iPhone app that shows you the posts that are ready and helps you share them. Loudwell doesn't post for you: you post from your phone, in each platform's own app. Windows and Android versions are coming soon.
Who can use it
You need to be 18 or over. Loudwell is meant for marketing a business, a product or yourself. If you use it for a company, you're agreeing to these terms for that company too.
Paying
The Mac app needs a monthly subscription, paid on our website through Stripe. The price is shown before you pay. It renews each month until you cancel, and you can cancel at any time from the link in your receipt or by emailing us; you keep access until the end of the month you've paid for. We don't refund part months, except where the law says we must.
If we change the price, we'll email you at least 30 days before it applies to you, and you can cancel before then.
The iPhone app is free and doesn't sell anything.
Your AI provider
Loudwell runs on AI keys you add from your own account with an AI provider, such as Anthropic or Google. That provider bills you directly for what Loudwell uses, at their prices and under their terms. Loudwell shows what each job costs and stops at the monthly cap you set, but the provider's bill is yours, and we aren't responsible for their charges, outages or decisions about your account. Keep your keys private.
Your content
What you put into Loudwell and what it makes for you belongs to you, as far as the law allows. You give us permission to handle it only as far as running Loudwell needs, for example passing posts from your Mac to your phone through the relay. Our privacy page says what happens to it.
Make sure you have the right to use the photos, videos, music and words you give Loudwell, and read what it makes before you post it. AI can get facts wrong or produce something close to someone else's work. You're responsible for what you post, and for following the rules of each platform you post on.
Fair use
Don't use Loudwell to break the law, to mislead people, to send spam, to impersonate anyone, or to harass anyone. Don't try to break into the relay, get around the subscription, or copy and resell the app. We can suspend or end your access if you do.
The iPhone app
The iPhone app is supplied through Apple's App Store under Apple's standard licence agreement for apps, alongside these terms. Apple isn't responsible for Loudwell or for supporting it; we are.
If something goes wrong
We work hard to keep Loudwell running and correct, but it's provided as it is, and we can't promise it will always be available, error free, or that any post will reach a particular audience. Social platforms change their apps and rules, and some features may stop working because of that.
As far as the law allows, our total liability to you for anything to do with Loudwell is limited to what you paid us in the 12 months before the problem. We aren't liable for lost profits, lost business, or losses we couldn't reasonably have foreseen. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or anything else the law doesn't allow us to limit. If you're a consumer, you also have legal rights that these terms don't affect.
Ending
You can stop using Loudwell and cancel at any time. If we ever stop offering Loudwell, we'll give you at least 30 days' notice and refund any time you've paid for and not used. What's on your Mac stays yours.
Changes to these terms
If we change these terms in a way that matters, we'll update the date above and email subscribers at least 30 days before the change applies.
Open source in Loudwell
The Mac app includes FFmpeg, licensed under the GNU LGPL version 2.1, and Electron. Their licences, the FFmpeg source and our written offer for it are on the Credits page; nothing in these terms limits your rights under those licences.
Law
These terms are governed by the law of England and Wales, and disputes go to its courts. If you live elsewhere in the UK or in the EU, you can also use your local courts and keep the protections of your local law.
